Indian Single Status Certificate (Affidavit) for Court Marriage in Nepal

Indian Single Status Certificate (Affidavit) for Court Marriage in Nepal

Here is a comprehensive article with specific examples for Indian citizens.

Why this is unique for Indians: Unlike other foreigners who bring "CENOMAR" or "No Objection Letters" from their home countries, Indian citizens have a unique advantage: they can often generate this document inside Nepal at the Indian Embassy in Kathmandu, which is faster than the SDM/MEA process in India.

Indian Single Status Certificate (Affidavit) for Court Marriage in Nepal

If you are an Indian citizen planning to do a Court Marriage in Nepal, the most critical document you need is proof that you are unmarried (Single Status).

In India, there is no single central authority that issues a "Bachelorhood Certificate." Therefore, the Nepal District Court accepts a Sworn Affidavit that declares your marital status.

However, you cannot just write this on a piece of paper. It must be a Legal Affidavit verified by the proper authorities.

Here are the two ways to get this, including the exact text format you need.

Method 1: The "Indian Embassy in Nepal" Route (Recommended)

This is the fastest and safest method. Instead of running around courts in India, you can visit the Embassy of India in Kathmandu (Lainchaur). They issue an official affidavit that is 100% accepted by all District Courts in Nepal.

The Process:

  1. Visit the Embassy: Go to the Consular Wing of the Indian Embassy in Lainchaur, Kathmandu (Mon-Fri, 9:30 AM - 12:30 PM).
  2. Submit Documents:
  • Original Indian Passport (or Voter ID, but Passport is preferred for marriage).

  • Photocopies of the Passport/Voter ID.

  • 3-4 Passport size photos.

  • Request Form for "Affidavit of Marital Status".
  1. Draft the Affidavit: You will swear an oath before the Consular Officer.
  2. Fee: Approx. NPR 3,000 - 4,000.
  3. Time: Usually issued the same day or next day.

Method 2: Bringing it from India (The Hard Way)

If you want to bring the document from India, a simple Notary stamp is NOT enough. The Nepal Court will reject a generic notary paper from Delhi or Mumbai.

It must follow this strict chain of attestation:

  1. Step 1: Draft an Affidavit on Stamp Paper (₹100).
  2. Step 2: Get it signed by a Sub-Divisional Magistrate (SDM) or Executive Magistrate.

  3. Step 3: Get it attested by the Home Department of your State.

  4. Step 4: Get it Apostilled/Attested by the Ministry of External Affairs (MEA) in Delhi/Patiala House.

Because this process is long, Method 1 is better.

Example Format: Affidavit of Single Status

If you are drafting this for the Indian Embassy or an SDM in India, here is the standard legal language required.

TITLE: AFFIDAVIT OF SINGLE STATUS

I, [YOUR FULL NAME], holder of Indian Passport Number [PASSPORT NO], issued at [PLACE OF ISSUE] on [DATE], currently residing at [YOUR FULL ADDRESS IN INDIA], do hereby solemnly affirm and declare on oath as follows:

  1. That I am a citizen of India by birth.
  2. That I was born on [DATE OF BIRTH] at [CITY, STATE], India.

  3. That my father's name is [FATHER'S NAME] and mother's name is [MOTHER'S NAME].
  4. That I am currently single/unmarried and have never been married to anyone in India or any other part of the world. (OR: If Divorced): That I was previously married to [EX-SPOUSE NAME] but the marriage was legally dissolved by the decree of [COURT NAME] on [DATE], and I have not remarried since.
  5. That I am mentally fit and of marriageable age as per the laws of India and Nepal.
  6. That there is no legal impediment to my marriage with [NAME OF FIANCÉ/FIANCÉE], holder of [Nationality] Passport/Citizenship No. [NUMBER].

I understand that if the above statement is found to be false, I shall be liable for punishment under the prevailing laws.

DEPONENT (Signature of Indian Citizen)

VERIFICATION Verified at [PLACE] on this [DATE] that the contents of the above affidavit are true and correct to the best of my knowledge.

Special Documents for Divorced Indians

If you are divorced, the "Single Affidavit" alone is not enough. You must also bring:

  1. Original Divorce Decree from the Indian Court.
  2. Certified Translation: If the decree is in Hindi, Marathi, Tamil, etc., it must be translated into English and Notarized.

Don't Risk Rejection

The most common mistake Indian citizens make is bringing a Rs. 50 Notary Paper from their local lawyer in Bihar or UP. The Nepal Court will reject this. It lacks the diplomatic seal.
