Court Marriage Age Limit in Nepal: What the Law Says (20 Years Rule)

Court Marriage Age Limit in Nepal: What the Law Says (20 Years Rule)

One of the most strictly enforced rules in the National Civil Code 2074 is the Court Marriage Age Limit in Nepal.

In the past, the age limit was lower, and there were exceptions for parental consent. However, the laws have changed. Today, the government is very aggressive about preventing child marriage. If you try to get married before the legal age, your marriage will not only be rejected, but you could also face jail time.

In this article, we clarify exactly what the legal marriage age is for both men and women in 2025.

The Magic Number: 20 Years Old

The law is simple and non-negotiable:

  • For Groom (Boy): Must have completed 20 years of age.
  • For Bride (Girl): Must have completed 20 years of age.

Unlike some other countries, there is no difference between the age for men and women. Both must be 20.

"But my parents agree!" (Does Parental Consent Help?)

This is a common myth.

  • Myth: "If my parents sign for me, I can get married at 18."
  • Fact: FALSE. Even if your parents, grandparents, and the entire village agree, you cannot legally register a court marriage if you are under 20. The District Court will check your Citizenship Certificate (Nagarikta) or Birth Certificate rigorously. If you are even 1 day short of your 20th birthday, the application will be rejected.

What Happens if You Marry Underage?

Attempting to marry before 20 is a criminal offense in Nepal.

  1. Marriage is Void: The marriage is considered "Null and Void" (Badar) by the court. Legally, it never happened.
  2. Jail Time: Under the National Penal Code, marrying a person under 20 is considered "Child Marriage." You can be punished with imprisonment for up to 3 years and a fine of up to NPR 30,000.
  3. Future Problems: An underage marriage certificate cannot be used for visas, property claims, or birth registration of children.

Why the Strict Rule?

The government of Nepal raised the age to 20 to ensure that both partners are physically and mentally mature, financially independent, and capable of making lifelong decisions. This protects young people from forced marriages and health risks.

Summary Checklist

Before you plan your court marriage, look at your Citizenship Card.

  • Date of Birth: [Your DOB]
  • Today's Date: [Current Date]
  • Is the gap exactly 20 years or more?

If the answer is Yes, you are ready to apply. If the answer is No, you must wait. There is no lawyer and no judge in Nepal who can bypass this rule.
